Consumer Protection

The advertisements of goods and services in televisions, newspapers and magazines influence the demand for same by the consumer though there may be manufacturing defects or shortcomings in the quality, quantity and the purity of the goods or there may be the deficiency in services rendered. For the welfare of the public, the glut of adulterated and substandard articles in the market have to be checked.

The Consumer Protection Act can be invoked to get better protection of the interest of consumers, for settlement of consumer disputes, seek redressal against unfair trade practices or unscrupulous exploitation.

Cheque Bouncing Cases

Are covered under ‘The Negotiable Instrument Act, 1881” – an act to define and amend the law pertaining to Promissory Notes, Bills of Exchange and Cheques.  Where any cheque drawn by a person on an account maintained by him with a banker for payment of any amount of money to another person from out of the account for the discharge, in whole or in part, of any debt or other liability, is returned by the bank unpaid, either because of the amount of money stands to the credit of that account is insufficient to honor the cheque or that it exceeds the amount to be paid from that account by an agreement made with the bank, such person shall be deemed to have committed an offence and shall without prejudice to any other provisions of this Act, be punished with imprisonment for ( a term which may be extended to two years) or with fine which may extend to twice the amount of the cheque or with both.
