Child custody law in India is governed by the Guardians and Wards Act 1890 and the Hindu Minority and Guardianship Act 1956. Mothers & fathers both have a prominent role to play in supporting the growth & development of their children. Often the people affected the most by a divorce aren't the adults, but the children. While deciding the question of custody court looks into several factors to conclude the best possible option for the child and its benefit. A child’s welfare is of paramount consideration.
