The judiciary must not take on the coloration of whatever may be popular at the moment. We are guardian of rights, and we have to tell people things they often do not like to hear.

Child custody law in India is governed by the Guardians and Wards Act 1890 and the Hindu Minority and Guardianship Act 1956. Mothers & fathers both have a prominent role to play in supporting the growth & development of their children.  Often the people affected the most by a divorce aren't the adults, but the children.  While deciding the question of custody court looks into several factors to conclude the best possible option for the child and its benefit. A child’s welfare is of paramount consideration. We, at Ashri Associates, focus on providing the support/ solutions keeping in mind the child’s future in the best way possible. We always try to encourage the parents to come to a mutual agreement on how exactly the responsibilities related to the child are divided.
